Stamp Duty & Property Registration Charges in India: State-by-State Guide

What is Stamp Duty on Property?

Stamp duty is a legal tax levied by the State Government on all property registration transactions executed within their jurisdiction. It is calculated as a percentage of the higher of the registered sale value or the government circle rate (DLC rate) of the property. Payment of stamp duty is a mandatory legal requirement under the Indian Stamp Act, 1899, and failure to pay renders the sale deed legally inadmissible in court.

Important: Stamp duty must be paid on the same day or before the property registration at the Sub-Registrar's office. Non-payment attracts a penalty of up to 10 times the unpaid duty amount.

Stamp Duty Rates Across Major States (2026)

State Stamp Duty (General) Women Buyer Concession Registration Fee
Rajasthan 6% (Urban), 5% (Rural) 1% Rebate for Women 1% (Max ₹50,000)
Maharashtra 6% + LBT 1% Concession 1% (Max ₹30,000)
Delhi 6% (Men), 4% (Women) 2% Concession 1% of value
Karnataka 5.6% No Concession 1% (Min ₹500)
Uttar Pradesh 7% (Men), 6% (Women) 1% Concession 1%
Gujarat 4.9% No Concession 1%

How to Calculate Stamp Duty: Practical Example

Let us assume you are buying a 200 square yard (Gaj) residential plot in Jaipur, Rajasthan, at a market price of ₹40,00,000 and the government circle (DLC) rate is ₹35,000 per sq yard (totalling ₹70,00,000).

Since registration must be done at the higher of market value or circle rate value, the applicable value is ₹70,00,000.

  • Stamp Duty @ 6% = ₹70,00,000 Ɨ 6% = ₹4,20,000
  • Registration Fee @ 1% (Max ₹50,000) = ₹50,000
  • Total Government Charges = ₹4,70,000

Documents Required for Property Registration

  2. Encumbrance Certificate (EC) for the last 13 years minimum
  3. PAN Card of buyer and seller
  4. Aadhaar Card of buyer and seller
  5. Passport-size photographs of both parties
  6. Two witnesses with Aadhaar identification

Special Stamp Duty Concessions & Exemptions

Women Buyer Discount

Most states provide a 1% to 2% stamp duty discount when the property is registered in a woman's name (wife, mother, or daughter). In Delhi, women pay 4% instead of 6%, saving ₹1,40,000 on a ₹70 Lakh property.

Joint Registration Benefit

When a property is jointly registered in the name of husband and wife, many states offer a 0.5% to 1% additional concession on the total stamp duty payable.

First-Time Homebuyer Exemption

Under Pradhan Mantri Awas Yojana (PMAY) Urban, first-time EWS/LIG category homebuyers availing a CLSS subsidy may qualify for partial stamp duty waiver in select states. Check with your state housing board for specific eligibility.

E-Stamping Process

Most states now support e-stamping through Stock Holding Corporation of India (SHCIL) authorized collection centers or through official state e-registration portals. E-stamps carry a unique certificate number verifiable online and eliminate the risks associated with physical stamp paper counterfeiting.

Penalty for Stamp Duty Evasion

If property is registered at an understated value to reduce stamp duty liability, the Sub-Registrar has the authority to flag the transaction and refer it to the Collector of Stamps for penalty assessment. Penalties range from 2Ɨ to 10Ɨ the deficit stamp duty amount, plus interest at 1.5% per month on the unpaid amount.

Key Takeaway

Always account for stamp duty and registration charges in your total property acquisition budget. In Rajasthan, these government fees can add 7% to the transactional cost of the property. Smart buyers register property in a woman's name to avail the 1% concession, saving several lakhs on large plot transactions.
